Fetal Monitor

Carolyn St. Clair has been a registered nurse since 1979, and worked as a highly trained operating room nurse for prominent heart surgeons in Houston, Texas. She has practiced law since 1986, focusing on medical litigation involving serious injury, birthing trauma, medical device defects and dangerous drugs. Her law practice assembles the most qualified experts to investigate and testify in personal injury claims to obtain settlements or hold the responsible parties accountable at trial.

Birthing Injuries: Cerebral Palsy | Brachial Plexus (Erb's Palsy)

Cerebral Palsy
Cerebral Palsy is caused by damage to the baby's brain in the cerebrum, which controls motor skills, higher mental faculties, sensations and voluntary muscles. This baby will show an inability to control some movements, difficulty with balance and walking, even blind or deaf and may be intellectually impaired. Cerebral Palsy cannot be cured and may be caused by lack of oxygen to the baby's brain during pregnancy, labor and delivery, or after birth.

Sadly, cerebral palsy is sometimes a result of a medical mistake or miscalculation during the birthing process. If the health care team does not recognize and respond to the baby 's distress early enough, the baby's oxygen supply may be decreased, resulting in cerebral palsy. The lifetime emotional and economic impact on the family and child are devastating and costly. Expert interpretation of fetal heart strips, lab values, blood chemistry, blood gases, cord blood analysis, spasticity, seizure activity of the baby is critical to proving the case on behalf of the baby and family.

Proving a large claim is expensive, but the Law Offices of Carolyn St. Clair, R.N., J.D. bears these expenses. Clients are charged no fees unless we are successful in obtaining a settlement or jury award of compensation. The litigation requires expert witnesses and treating specialists, including: a Board Certified OB-Gyn doctor, Fetal Heart Monitoring expert, Pediatric Neurologist, Pediatric Neuroradiologist, Maternal Fetal Nurse, Life Care Planner, and Economists. Rehabilitative medical care for the brain damaged child is a critical and essential element for recovery and usually continues throughout the child's lifetime. We have successfully litigated birth related brain damaged baby cases and received a life time of care for these children and their families.

Brachial Plexus or Erb's Palsy
Brachial Plexus or Erb's Palsy results when the nerves connecting the spinal cord to the wrist are damaged resulting in complete paralysis or loss of use to the arm or hand. Erb's Palsy may happen during labor and delivery due to the baby's shoulder being wedged in the mother's pelvic bone or excessive stretching of the baby's neck and shoulder. We understand these birthing injuries can create lifelong hardship for the children and their families. To prove a claim for compensation, expert witnesses will be required including an OB-Gyn doctor, plus the costs of video depositions, medical and radiology reports and graphic technologists. Medical and rehabilitation care for the Brachial Plexus injured child may continue throughout the child's life. We have successfully litigated birth related Brachial Plexus and Erb's Palsy cases and received the necessary compensation for these children and their families.
